White Collar Business Attorney

Attorney W. Scott Harkey Harkey Quoted in Business North Carolina Magazine

White Collar criminal defense attorney W. Scott Harkey was quoted in an article in the September 2022 issue of Business North Carolina magazine. The article, “NC trend: Law firms rise in defense of white-collar executives,” discusses the emerging demands for white-collar defense in North Carolina.

“There definitely is a greater interest in [white-collar] cases, and there’s been an uptick in prosecutions,” said Harkey. This trend has sparked many North Carolina law firms to emphasize white-collar cases as part of their practice.

The article features Kearns Davis of Brooks, Pierce McLendon, Humphrey & Leonard, who spearheads the firm’s white-collar defense group. “I’ve seen him having an impact beyond representing his clients and showing that it’s not just about him,” says Harkey. “He’s been extraordinarily selfless in trying to help improve our profession.”

“There definitely is a greater interest in [white-collar] cases, and there’s been an uptick in prosecutions.”

Harkey provides counsel and defense to corporations, individuals, and executives facing white-collar investigations in state and federal courts. Previously, Harkey served as a senior financial-crimes prosecutor who represented the state in dozens of major fraud cases.

Business North Carolina is North Carolina’s largest business magazine. The publication, around for over 40-years., covers business trends, people, and businesses that make up North Carolina’s business community. To access the article, Click Here.

Criminal Law, Fraud, White-Collar
Obtaining property by false pretenses is the most commonly charged non-violent felony in North Carolina. Obtaining property by false pretense occurs when 1) someone makes a false representation; 2) the representation is calculated and intended to deceive; 3) the other party is in fact deceived; and 4) the person obtains something of value. It is not a "catch-all" offense.
