Attorney W. Scott Harkey of Harkey Litigation was recently featured in a WFMY News 2 story discussing the legal implications and community concerns surrounding the reopening of the Food Lion on Lawndale Drive in Greensboro, North Carolina. The store had been closed since December 23, when Greensboro Police Officer Michael Horan was tragically shot and killed on the premises.

Legal Insights on Firearm Policies

He elaborated that while open carry is permitted in public spaces, there are strict rules about how firearms can be used. “Carrying in public, it needs to be open carry, which means people need to be able to see it. Also, you certainly can’t take that firearm out, without an exception. In other words, you can’t take that firearm out, point it at someone and use it in a threatening manner,” he added

Criminal Defense Attorney Scott Harkey provided crucial legal context in his interview with WFMY News 2. He explained the laws governing firearm possession in public and private spaces in North Carolina. “Here in North Carolina, we’re a state that encourages people to carry and carry openly.” Harkey also discussed the interplay of gun possession laws, concealed carry laws, and their application to private businesses.

Harkey also noted that private businesses, such as Food Lion, have the authority to establish their own firearm policies. This legal nuance is critical as communities and businesses navigate the balance between public safety and individual rights.
